Lawsuit Over Disclosing Personal Medical Information

[Posted 10/06/2008] The Equal Employment Opportunity Commission (EEOC) is suing the Dillard Store Services, Inc. for unlawful disability-related inquiry under the Americans with Disabilities Act (ADA) not justified by business necessity. Dillard’s is a department store chain, with corporate headquarters based in Little Rock, Arkansas.

The lawsuit stems from the firing of a sales associate at one of the Dillard’s stores in California. The sales associate was out of work on sick leave for a few days and returned to work with a doctor’s note. When questioned about her illness, she refused to disclose her medical condition and was subsequently fired.

The EEOC filed suit in a US District Court in southern California following failure to reach a voluntary settlement.
