Investigation: $300,000 in Punitive Damages

The Occupational Safety and Health Administration
(OSHA) has ruled against Metro North Commuter
Railroad Company for illegal actions against
four employees. The company provides commuter rail
service in New York, New Jersey, and Connecticut.
The four employees had sustained work-related
injuries in 2007 and 2008 and suffered retaliation
once they reported these injuries. They subsequently
filed whistleblower complaints against these
retaliatory actions, which included:

disciplining the employees for reporting
injuries
-
interfering with medical treatment
-
reclassifying occupational injuries as
non-occupational
OSHA
deemed the complaints have merit and has ordered
Metro North to take corrective policy and
administrative action plus pay $300,000 in punitive
damages to the complainants.
