Postponement of Part of New DOT Drug Testing Rule

[Posted 08/25/2008] The Department of Transportation (DOT) has decided to delay the implementation of one of its new drug testing provisions: 40.67(b). The other provisions went into effect as planned on August 25, 2008.

The provision in question deals with the requirement that employers ensure all follow-up and return-to-work drug tests are directly observed. The revised effective date is November 1, 2008. DOT is requesting a one-month commenting period on this provision, as well.
